Limitation of liability
Nothing in these Terms exclude, restrict or modify any guarantee, term, condition, warranty, right or remedy implied or imposed by any applicable legislation that cannot lawfully be excluded or limited, including, to the extent applicable, the Australian Consumer Law (Non-Excludable Provision).
Subject to any Non-Excludable Provision applicable to each Roundtable Member and to the maximum extent permitted by law:
- the Roundtable Members are not under any circumstances, liable for damages of any kind arising out of or in connection with this Website or its content;
- the Roundtable Members exclude all express or implied guarantees, warranties, representations, or other terms and conditions relating to these Terms or its subject matter, not contained in these Terms; and
- to the extent any liability arising out of or in connection with this Website or its content cannot be lawfully excluded by the Roundtable Member: (i) no Roundtable Member is liable for any indirect, consequential or special loss or damage; and (ii) the maximum aggregate liability of any Roundtable Member to you in connection with this Website including any materials accessible on or through it, is limited to AUD$1,000 per entity, whether in contract, tort (including without limitation negligence), under statute or otherwise.
The liability of any Roundtable Member to you is diminished to the extent that your acts or omissions (or those of a third party) contribute to or cause the relevant loss or damage.
If any Non-Excludable Provisions apply to AP+ and/or AusPayNet, and AP+ and/or AusPayNet is able to limit your remedy for a breach of the Non-Excludable Provision, then liability for breach of the Non-Excludable Provision is limited to one or more of the following at the option of AP+ and/or AusPayNet (as relevant):
- in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again. - Each Roundtable Member is an intended beneficiary of the exclusions and limitations of liability set out in these Terms to the extent applicable to them. You agree that each Roundtable Member may enforce those provisions directly against you.

The Account-to-Account Payments Roundtable brings together Australian Payments Network (AusPayNet), Australian Payments Plus (AP+), the Reserve Bank of Australia (RBA), and Commonwealth Treasury to support discussion and coordination on the future of account-to-account payments in Australia. The Roundtable is not a governance or decision-making body. Participating organisations retain their respective responsibilities, governance arrangements, and independence. This website is managed by Australian Payments Plus (AP+) on behalf of the Account-to-Account Payments Roundtable.
In the spirit of reconciliation, the Account-to-Account Payments Roundtable acknowledges the Traditional Custodians of country throughout Australia and their connections to land, sea and community. We pay our respect to their Elders past and present and extend that respect to all Aboriginal and Torres Strait Islander peoples.
